Terms of use.

These terms cover your use of the Bugback app and this website. They are written to be read. By installing or using Bugback you accept them.

Who is who

Bugback is a sole trader business in New Zealand ("I"). "You" is the person using it, or the organisation you use it for.

Changes to Bugback

Bugback will change over time. Features may be added or removed, and I will say so on the website when it matters to you. What the Free and Pro plans include, and their prices, are on the pricing page.

Free trial, Free and Pro

The first time a Mac opens Bugback it gets 14 days of Pro, with no card. After that the Free plan applies unless you have a Pro licence key. Pro is a subscription, monthly or yearly. It is sold by Polar, a merchant of record, so Polar is the seller: it takes the payment and collects sales tax, and its terms apply to the purchase. A licence key is for you and works on one Mac at a time. To move it to another Mac, remove it from the first in Settings, or write to me. Do not share it.

A subscription renews until you cancel it in Polar's customer portal. Cancelling stops the next payment, and you keep Pro until the end of the period you have paid for. When it ends, or if a payment fails, the key stops working and Bugback returns to the Free plan the next time it starts. A licence never stops a recording that is already running. Bugback checks the key with Polar when it starts and about once a day, and a key that worked keeps working for 14 days if Polar cannot be reached.

Refunds

If Pro is not for you, write to hello@bugback.app within 14 days of your first payment, monthly or yearly, and I will refund it in full. If a yearly renewal takes you by surprise, the same applies for 14 days from that payment. Monthly renewals are not refunded, so cancel before the next one if you do not want it. A refund ends that subscription, and its key stops working. Polar handles order questions and returns for me, and may also refund a payment itself, for example to prevent a dispute. Where the law gives you more than this, the law applies.

Your licence

I give you a personal, non-exclusive licence to install and use Bugback on your own Macs, for work or for yourself. You may not copy, sell, rent or share the app, reverse engineer it, or remove its notices, except where the law says you may.

Recording other people

Bugback records your screen, which can show other people's messages, faces, data and work. You are responsible for having the right to record what you record and to send it where you send it. Follow your employer's rules and the law where you are, and get permission when you need it. Hide apps you should not record, and read a clip before you send it.

Your content

Your clips, notes and tickets are yours. I do not receive them and claim no rights over them. You are responsible for what you send to Jira or anywhere else.

Third-party services

Sending to Jira uses your Atlassian account and is governed by Atlassian's terms. I am not responsible for Atlassian's service or for what it does with your data. The same goes for Polar and what it does with your payment and licence details.

No warranty

Bugback is provided as it is. I do not promise that it will be uninterrupted or error-free, or that it will capture every bug. Do not rely on it as your only record of something important.

Limit of liability

To the extent the law allows, I am not liable for indirect or consequential loss, lost profits or lost data arising from your use of Bugback, and my total liability is limited to the amount you paid for Bugback in the past 12 months. Nothing here limits rights you have under law that cannot be excluded, such as the New Zealand Consumer Guarantees Act where it applies.

Ending

You can stop using Bugback at any time by deleting it. I may stop supporting Bugback or end your access if you break these terms.

Law

These terms are governed by the law of New Zealand, and its courts have jurisdiction, unless your local law says otherwise.
